What Can Be Copyrighted?

Work Categorisation

Identify the category of your work (literary, artistic, musical, software, film, or sound recording) as this determines the application form and fee applicable under the Copyright Act.

Prepare the Application

Complete the copyright application (Form XIV) with details of the work, its nature, year of creation, author details, and ownership. For software, a redacted version of source code may be required.

File Online at Copyright Office

File the application at the Copyright Office portal (copyright.gov.in) with the requisite government fee. Upload two copies of the work as required by the Copyright Office.

Diary Number Issuance

The Copyright Office issues a Diary Number immediately upon successful submission. This Diary Number is the reference for tracking the status of your application.

Mandatory 30-Day Waiting Period

There is a mandatory waiting period of 30 days during which any third party can file an objection to the registration of the copyright. This is a statutory requirement under the Act.

Objection Examination (If Any)

If an objection is received, both parties are given a hearing. If no objection is raised within 30 days, the Copyright Office proceeds to examine the application independently.

Copyright Office Examination

The Copyright Office examines the application for completeness, correctness, and eligibility. Queries (if any) are communicated to the applicant. Timely response is critical.

Registration Certificate

Upon satisfactory examination and no valid objection, the Copyright Office issues the Copyright Registration Certificate with the unique registration number and effective date of registration.
